Este Acuerdo regula tu acceso anticipado y gratuito a la app NutriSync (el "Piloto"), ofrecido por [NOMBRE O RAZÓN SOCIAL DEL RESPONSABLE], [NIF/CIF], con domicilio en [DIRECCIÓN POSTAL COMPLETA], España ("NutriSync", "nosotros"). Contacto: contact@nutrisynccollective.com.
Al aceptar este Acuerdo, participas voluntariamente como persona probadora. La Política de Privacidad y el Aviso de Salud se te facilitan como información. El consentimiento explícito para datos de salud y cualquier consentimiento de cookies o marketing se solicitan mediante acciones separadas.
Debes tener al menos 16 años y residir en un país donde el Piloto esté disponible. Si tienes 16 o 17 años, podrán aplicarse requisitos adicionales de capacidad o autorización conforme a la ley de tu residencia. No debes utilizar el Servicio si no cumples esos requisitos.
NutriSync ofrece información de bienestar y no sustituye la atención sanitaria. Antes de utilizar las funciones de salud, debes leer el Aviso de Salud.
El uso de datos de ciclo, síntomas, biometría o salud requiere un consentimiento explícito, informado y separado. Puedes retirar ese consentimiento sin incumplir este Acuerdo; las funciones que dependan de esos datos dejarán de estar disponibles. Tus derechos y los plazos de supresión se describen en la Política de Privacidad.
No estás obligada a enviar comentarios. Si lo haces, concedes a NutriSync una licencia no exclusiva, mundial, gratuita y transferible a proveedores que trabajen para NutriSync, únicamente para analizar, reproducir y utilizar esos comentarios con el fin de mejorar el Servicio. No incluyas datos personales o de salud de terceras personas.
Te pedimos que no publiques capturas, grabaciones o detalles técnicos de funciones no anunciadas sin autorización previa. Esta obligación no impide comunicarte con asesores, autoridades o profesionales, ejercer derechos legales, denunciar conductas ilícitas ni describir honestamente tu experiencia general.
El Piloto se facilita con las limitaciones propias de un producto beta. Nada de este Acuerdo excluye o limita derechos irrenunciables de consumidores, derechos de protección de datos, responsabilidad por dolo o culpa grave, daños personales cuando legalmente no puedan excluirse, fraude ni cualquier otra responsabilidad que la ley prohíba limitar.
En la medida permitida por la ley, NutriSync no responde de pérdidas indirectas o imprevisibles derivadas del uso voluntario del Piloto. La gratuidad del Piloto podrá tenerse en cuenta al determinar remedios o responsabilidad solo cuando la normativa aplicable lo permita. No se establece una limitación automática de 0 €.
Puedes abandonar el Piloto en cualquier momento. También podremos suspender o finalizar el Piloto o tu acceso por motivos técnicos, de seguridad, legales, de uso indebido o por transición al lanzamiento público, con preaviso razonable cuando sea posible. La finalización del acceso no elimina tus derechos sobre los datos.
Te informaremos de las opciones para exportar o suprimir datos y de los plazos aplicables. No convertiremos tu cuenta en una suscripción de pago sin tu aceptación expresa de las nuevas condiciones y del precio.
Podemos modificar este Acuerdo para reflejar cambios del Piloto o de la ley. Te avisaremos de cambios materiales antes de que entren en vigor. Si el cambio requiere una nueva aceptación, no se aplicará hasta que la otorgues; podrás abandonar el Piloto.
El Acuerdo se rige por la ley española, sin privarte de las protecciones imperativas de consumidores y datos de tu país de residencia ni de los tribunales competentes que te reconozca la ley.

This Agreement governs your free early access to the NutriSync app (the "Pilot"), provided by [CONTROLLER LEGAL NAME], [TAX/COMPANY NUMBER], of [FULL POSTAL ADDRESS], Spain ("NutriSync", "we", "us"). Contact: contact@nutrisynccollective.com.
By accepting this Agreement, you volunteer as a tester. The Privacy Policy and Health Notice are provided as information. Explicit health-data consent and any cookie or marketing consent are requested through separate actions.
You must be at least 16 and reside in a country where the Pilot is available. If you are 16 or 17, additional capacity or authorisation requirements may apply under the law of your residence. Do not use the Service unless you meet those requirements.
NutriSync provides wellbeing information and is not a substitute for healthcare. Read the Health Notice before using health-related features.
Use of cycle, symptom, biometric or health data requires separate, informed, explicit consent. You may withdraw that consent without breaching this Agreement; features that depend on those data will cease to be available. Your rights and erasure periods are described in the Privacy Policy.
You are not required to submit feedback. If you do, you grant NutriSync a non-exclusive, worldwide, royalty-free licence, transferable to providers working for NutriSync, solely to analyse, reproduce and use the feedback to improve the Service. Do not include another person's personal or health data.
Please do not publish screenshots, recordings or technical details of unannounced features without prior authorisation. This does not prevent you from speaking to advisers, authorities or professionals, exercising legal rights, reporting unlawful conduct or honestly describing your general experience.
The Pilot is provided with the limitations inherent in a beta product. Nothing in this Agreement excludes or limits mandatory consumer rights, data protection rights, liability for wilful misconduct or gross negligence, personal injury where exclusion is prohibited, fraud or any other liability that cannot legally be limited.
To the extent permitted by law, NutriSync is not liable for indirect or unforeseeable losses arising from voluntary Pilot use. The free nature of the Pilot may be considered when determining remedies or liability only where applicable law permits. There is no automatic €0 liability cap.
You may leave the Pilot at any time. We may suspend or end the Pilot or your access for technical, security, legal or misuse reasons, or to transition to public launch, with reasonable notice where possible. Ending access does not remove your data rights.
We will explain options to export or erase data and the applicable periods. We will not convert your account into a paid subscription without your express acceptance of the new terms and price.
We may amend this Agreement to reflect Pilot or legal changes. We will give advance notice of material changes. Where new acceptance is required, the change will not apply until you accept it; you may leave the Pilot.
Spanish law governs this Agreement without depriving you of mandatory consumer and data protections in your country of residence or any court jurisdiction granted to you by law.
